Remanufactured Components

Blumenthal Manufacturing Co., Inc., hereinafter referred to as BMF, warrants its remanufactured manual transmissions, transfer cases and remanufactured differentials to the original purchaser to be free from defects in material and workmanship, under normal use and service, for a period as stated on the invoice with the exclusions noted herein. New transmissions, transfer cases, differentials, clutches and parts carry the original manufacturers warranty only.  BMF warranties are not transferable and include exchange, repair or reimbursement at BMF’s sole discretion.  In the event that BMF authorizes a warranty exchange, (only installations at BMD cover labor), labor shall be reimbursed at 100% of the hours listed in the Chilton Labor Guide and Parts Manual at a rate of $30.00 per hour. The maximum time allowance to remove and replace a manual transmission, transfer case or differential shall not exceed six (6) hours, or $180.00. The labor allowance for an authorized field repair (repair not requiring replacement) shall not exceed three (3) hours and shall be paid at $30.00 per hour.  The BMF warranty becomes effective on the date of purchase when the warranty card is returned from the original purchaser within 30 days of purchase.  Failure to return warranty card to BMF within 30 days of sale date shall void warranty. Failure to obtain prior approval from BMF before disassembly or service on any BMF remanufactured transmission, transfer case or remanufactured differential immediately voids warranty. BMF approval must be given in the form of a purchase order number or RGA number. All vehicle maintenance records must be made available to BMF at the time of warranty request. Both parties agree to mediation prior to any court or legal action against the other party.

 

The BMF limited warranty does not cover the following:

a) Use of a product for purposes for which it was not originally designed such as overloading, off-road or in a racing application;

 

b) Abuse, overheating, neglect, accident, fire, theft, terrorism, war, natural disasters, improper towing or burnt or broken gears;

 

c) Improper installation and/or improper maintenance, including failure to fill and maintain the unit with the proper fluid and at the proper level;

 

d) Towing charges;

 

e) Vehicle rental;

 

f) Loss of time, inconvenience, loss of use of vehicle, incidental loss and punitive and/or consequential damages or any other loss due to downtime or product failure;

 

g) Failure because of defects or inefficiencies in parts or assemblies not provided by BMF such as pilot bushing/bearing, clutch, clutch assemblies, yokes, driveline or axle shafts;

h) Return freight on the alleged defective unit.

Repair or replacement under warranty does not extend the warranty beyond the original purchase date.

This warranty is in lieu of any and all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Remedies and damage, whether in contract, tort, or otherwise are limited to those expressly provided in this warranty. In no event, whether as a result of breach of contract, breach of warranty or alleged negligence or any other cause whatsoever, shall BMF be liable for special, incidental or consequential damage.  By the acceptance of the product(s) the purchaser agrees, except with respect to product warranty claims, for which BMF’s obligations are set forth in this limited warranty, to protect, defend, hold harmless and indemnify BMF from and against any and all claims, actions, liabilities, losses, damages, costs and expenses including, without limitation, legal costs, punitive damages, consequential damages and/or penalties, arising out of any cause by whosoever suffered.  Purchaser further agrees that any legal action what-so-ever be brought before the jurisdiction of the courts in Oklahoma County, in the State of Oklahoma and all costs shall be paid by purchaser.

 

Warranty procedures for original purchaser:

The attached Warranty Registration Card must be received by BMF within 30 days of date of sale.

Please have the following information ready:

  • Transmission, transfer case or differential production/serial number from BMF tag;
  • Invoice number and date;
  • Detailed nature of the problem;
  • Faxable maintenance records of the vehicle;

Please follow all instructions given for any warranty return or warranty service*.

*All warranty service must have BMF approval.

 

Core Return Policy

Core credit will be extended to the original purchaser after the core unit has been returned prepaid within 90 days of the date of sale and received in the specially designated container originally provided by BMF or individually skidded and secured. The deduction of credit for cores returned shall be as follows:

 

  • Case broken, cracked or bulging – Up to 100% of core value;

 

  • Clutch housing broken, cracked or bulging – Up to 100% of core value;

 

  • Cracked or missing tail housing - 70% of core value;

 

  • Bearing Cap(s) broken or missing - 40% of core value;

 

  • Failure to drain and clean a unit - 5% of core value (If unit is ‘shipped’ with fluid, any and all EPA fines/fees will be to shipper)

 

  • Core is received disassembled in a box or other container – Up to 100% of core value;

 

  • Overheated core due to lack of lubrication, misuse or fire - 100% of core value (no value).

 

Failure to drain and clean oil from a unit is NOT acceptable by the EPA Hazardous Materials Shipping Guidelines and the BMF shipping and receiving department will not accept delivery from any common freight carrier of any unit not drained.
